Please read these Terms & Conditions carefully before using diamondandhide.com (the "site") or purchasing any productions from Diamond & Hide, LLC ("Diamond & Hide," "we," "us," or "our"). By accessing or using our site, you agree to be bound by these Terms. If you do not agree, please do not use our site.

1. General

Diamond & Hide, LLC is a Nebraska limited liability company operating in Omaha, Nebraska. We design and sell premium leather handbags, purses, wallets, and accessories inspired by the craftsmanship of the baseball glove.

These Terms apply to all visitors, customers, and users of the site.

2. Use of the Site

You agree to use our site only for lawful purposes and in a manner consistent with these terms. You agree not to:

• Use the site in any way that violates applicable federal, state, or local laws or regulations
• Attempt to gain unauthorized access to any part of the site or its related systems
• Transmit any harmful, offensive, or disruptive content through the site
• Use the site to collect personal information about other users without their consent
• Copy, reproduce, or redistribute any content from the site without our express written permission
• Use automated tools, bots, or scrapers to access, monitor, or copy content from the site

We reserve the right to terminate access to the site for any user who violates these Terms.

3. Products and Availability

All products displayed on our site are subject to availability. We reserve the right to limit quantities, discontinue products, or change product offerings at any time without notice.

Product images on the site are for illustrative purpose. While we make every effort to display colors and details accurately, slight variations may occur due to monitor settings, photography lighting, and the natural characteristics of the leather.

Each piece of leather is unique. Natural grain patterns, markings, and slight color variations are characteristics of genuine leather and are not considered defects.

4. Pricing

All prices are listed in US dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time. If a product is listed at an incorrect price due to a typographical error, we reserve the right to cancel any orders placed at the incorrect price and notify you accordingly.

Prices do not include applicable taxes or shipping costs, which will be calculated and displayed at checkout.

5. Orders and Payment

By placing an order, you represent that you are at least 18 years of age and that information you provide is accurate and complete.

We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, that excess quantity limits, or that cannot be verified.

Payment is due at the time of purchase. We accept major credit and debit cards, PayPal, and other payment methods as displayed at checkout. All transactions are processed securely through our payment processor. Diamond & Hide does not story your full payment card information. 

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to cancel orders after confirmation if a product becomes unavailable or if we are unable to verify payment.

6. Shipping and Delivery

We ship to addresses within the United States. International shipping may be available on a case-by case basis. Shipping rates and estimated delivery times are provided at checkout.

We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control. Risk of loss and title for products purchased pass to you upon delivery to the shipping carrier.

If your order is lost or damaged in transit, please contact us at orders@diamondandhide.com within 7 days of the expected delivery date.

7. Returns and Exchanges

We want you to love your Diamond & Hide purchase. If you are not completely satisfied, please review our Return Policy, which is incorporated into these Terms by reference.

Key points:

• Returns are accepted within 14 days of delivery for unused, unworn items in original condition
• Items must be returned in their original packaging with all tags and authenticity cards attached
• Personalized or monogrammed items are final sale and cannot be returned or exchanged
• Sale items are final sale and cannot be returned or exchanged
• Shipping costs for returns are the responsibility of the customer unless the item is defective or we made an error
• Original shipping costs are non-refundable

To initiate a return, contact us at returns@diamondandhide.com with your order number and reason for return. We will provide return instructions.

8. Warranties and Product Defects

Diamond & Hide products are crafted with premium materials and careful attention to quality. Each product is inspected before shipment.

If you receive a product with manufacturing defect, please contact us at founder@diamondandhide.com within 30 days of delivery with a description and photographs of the defect. We will evaluate the claim and, at our discretion, repair, replace, or issue a refuse for defective items.

This warrant does not cover:

• Normal wear and tear
• Damage caused by improper care, misuse, or accidents
• Natural variations in leather grain, texture, or color
• Fading or patina that develops over time with use

9. Intellectual Property

All content on the site, including but not limited to text, graphics, logos, images, product designs, the Diamond & Hide name, the DH monogram, and all associated trademarks and trade dress, are the property of Diamond & Hide, LLC and are protected by applicable intellectual property laws.

"Diamond & Hide" and the DH monogram are trademarks of Diamond & Hide, LLC pending registration with the United State Patent and Trademark Office. 

You may not use, reproduce, distribute, modify, or create derivative works from any content on the site without our express written permission. Unauthorized use of our intellectual property may result in legal action.

10. User Content

If you submit reviews, testimonials, photos, or other content to the site or our social media channels, you grant Diamond & Hide a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and distribute that content in any media for marketing and promotional purposes.

You represent that any content you submit is your own original work and does not infringe on the rights of any third party.

11. Third-Party Links

Our site may contain links to third-party websites or services that are not owned or controlled by Diamond & Hide. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit. 

12. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIAMOND & HIDE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM. 

Some jurisdictions do not allow the exclusion of limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Diamond & Hide, LLC and its members, officers, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nebraska, without regards to its conflict of law principles. Any dispute arising from these Terms or your use of the site shall be resolved in the state or federal courts located in Douglas County, Nebraska, and your consent to personal jurisdiction in those courts.

Before initiating any formal legal proceeding, you agree to first contact us at hello@diamondandhide.com and attempt to resolve the dispute informally.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Diamond & Hide, LLC regarding your use of the site and supersede any prior agreements.
